These General Terms and Conditions of Sale (GTCS) apply to all sales made on the website cleeugratin.fr, operated by SAS KICK ENGINEERING MUSIC, registered with the Pontoise Trade and Companies Register under number 930 415 799, with its registered office at 12 avenue du général de Gaulle, 95100 Argenteuil.


1. Purpose and Acceptance of the GTCS

These General Terms and Conditions of Sale (GTCS) define the rights and obligations of SAS KICK ENGINEERING MUSIC (hereinafter "the Seller") and the buyer (hereinafter "the Customer") in the context of the online sale of clothing and accessories under the brand C LEEU GRATIN.

Acceptance: Any order placed on cleeugratin.fr implies unconditional acceptance of these GTCS. The Customer declares having read and accepted the GTCS in full before validating their order.


2. Products and Orders

2.1. Product Description

The products offered for sale are those listed on the cleeugratin.fr website at the time of the order. The Seller strives to present the products with the greatest accuracy, but cannot guarantee the perfect conformity of colors and textures due to possible variations related to screens and photography.

2.2. Placing an Order

  • The Customer can place an order directly on the website, 24/7.
  • Validation of the order implies acceptance of the GTCS and full payment of the price.
  • The Seller reserves the right to cancel or refuse any order in case of suspected fraud, obvious error, or stock shortage.

2.3. Order Confirmation

The Customer receives an order confirmation email summarizing the products ordered, their price, and delivery information. This email serves as proof of the transaction.


3. Prices and Payment

3.1. Prices

Product prices are indicated in euros (€), including all taxes (VAT included). Delivery fees are indicated before order validation and added to the total amount.

3.2. Payment Methods

Payment is made online, by credit card (CB, Visa, Mastercard) or via secure payment solutions (PayPal, Stripe, etc.). Payment is required at the time of order validation.

3.3. Payment Security

Transactions are secured by an SSL protocol. No banking information is retained by the Seller.


4. Delivery

4.1. Delivery Times and Fees

  • Delivery times are indicated during the order process and vary depending on the chosen delivery method (Colissimo, Chronopost, etc.).
  • Delivery fees are calculated based on weight, volume, and delivery address.

4.2. Delays and Delivery Issues

In case of delay, the Customer will be informed by email. If the product is not delivered within 30 days of the expected date, the Customer may cancel the order and receive a full refund.

4.3. Receipt of Products

The Customer must check the condition of the products upon receipt. Any claim for apparent defects or damage must be reported to the Seller within 48 hours of delivery, by email to contact@cleeugratin.fr.


5. Right of Withdrawal

In accordance with Article L. 221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to justify their decision or pay any penalties.

5.1. Withdrawal Procedure

  • The Customer must notify their decision to withdraw by email to contact@cleeugratin.fr.
  • Products must be returned in their original condition, with their labels and packaging, to the address specified by the Seller.

5.2. Refund

The Seller will refund the returned products within 14 days of receipt, using the same payment method as the original order.


6. Warranties

6.1. Legal Warranty of Conformity

Products benefit from the legal warranty of conformity (Articles L. 216-1 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

6.2. Commercial Warranty

The Seller may offer an additional commercial warranty, the terms of which will be specified on the product sheet or at the time of purchase.


7. Liability

The Seller cannot be held liable for indirect damages (loss of profit, commercial damage, etc.) resulting from the use or inability to use the products sold.

The Seller generally recommends washing textile items before their first use. This advice applies broadly and is not specific to thier products.


8. Personal Data

Personal data collected during the order process is processed in accordance with the Privacy Policy of the website, in compliance with the GDPR. It is used solely for order processing and customer relations.


9. Disputes and Mediation

In the event of a dispute, the Customer may use consumer mediation. The mediator's contact details will be provided upon request.

Competent Jurisdiction: The courts of Pontoise (95) have sole jurisdiction in the event of a dispute.


10. Modification of the GTCS

The Seller reserves the right to modify these GTCS at any time. The applicable GTCS are those in effect at the time of the order.
